One of the eligibility criteria is that you must be a member or fee payer in one of the following APEA/AFT bargaining units:

  • Confidential Employees Association (CEA)

  • Fairbanks North Star Borough (FNSB)

  • Juneau Education Support Staff (JESS)

  • Nome Joint Utilities (NJU)

  • State of Alaska Supervisory Unit (SU)

  • Alaska Higher Education Crafts & Trades Employees Association (AHECTE)

Note to State of Alaska Employees:

If you work for the State of Alaska and you are not in the Supervisory Unit or the Confidential Employees Association, it's possible you are in the General Government Unit (GGU). GGU members also have a legal trust benefit with their union, the Alaska State Employees Association (ASEA). We also coordinate benefits for you. If you are married to another APEA/AFT member, please let us know by completing that portion of the Member Agreement form. If your spouse (or dependent) also has a legal service benefit (i.e. ASEA for GGU members), the primary member's union pays first and routes the payment copy to the secondary member's union for either payment or file. A primary member is defined as having the earlier birth month and day.

The legal services plan will pay $2,500.00 on your behalf for covered services each fiscal year. Our fiscal year runs from July 1 thru June 30. This benefit amount does not carry over into the next fiscal year. 

You should always check out the list of attorneys we've recruited in your area before receiving legal services elsewhere. The "Plan A" attorneys listed have agreed to charge our members no more than $140.00 per hour. If the attorney you would like to handle your case is not on our list Section 4 of the Plan Booklet explains in detail the difference between using a Plan A vs. Plan B attorney. Plan B attorneys are not restricted to $140.00 per hour rate. When a Plan B attorney charges more than $140.00 per hour, the Trust will only pay $60.00 per hour. This would leave a large financial responsibility to the member.
